In relation to Physical Products, the User has fourteen (14) calendar days from receipt to resolve the purchase and return the Physical Product with which he is not satisfied, without justification or penalty. For this, the User must communicate his withdrawal to Neki, by means of an email to, identifying in the subject "Return", and indicating in the mail, simply, his intention to return the Physical Product, his contact information and the identification of the order. Next, you must send the Physical Product to Neki's address, along with the invoice, at your own expense for the return. The returned Physical Product must be in perfect condition, in its original packaging, with all its manuals and accessories.The User will be responsible for the possible damages suffered by the Physical Product during transport. The right of withdrawal will not be applicable to Products and Services customized or made according to User specifications; that, by their nature, cannot be returned or may deteriorate or expire quickly; as well as sound or video recordings, discs and computer programs that have been unsealed by the User; and computer files, supplied electronically, capable of being downloaded or reproduced immediately for permanent use.
If the returned device does not meet the return requirements (damaged packaging, open product, missing instructions, etc.), the locator will not issue a refund and the company will send the customer a notification email. Only services and subscriptions will be reinstated.
Cancellation of subscription plans must be notified by sending an email to soporte@neki.es prior to the end date of the subscription. During the contracting process, the User must provide name, address, NIF (ID), website, contact email, contact telephone number. This information is intended to: (i) allow the dissemination of the Advertising and the contact of Neki users with the User who advertises the product, service or activity; and (ii) allow billing of the service by Neki. The contact information included by the User will be accessible to any Neki user.
The User agrees to provide the information required for contracting the Services and that it is truthful, complete and up-to-date.
This information will be added to the rest of the information associated with the User and will be available in their Neki user profile, within the "I want my device" tab, and can be modified whenever they want and being submitted, in what is not foreseen in this section and to the extent that it is considered personal data, the Privacy Policy.
3. Contracting the Payment and Billing Services
To contract the Services, the User must complete the contracting form on the Neki website and follow the steps and instructions established for this purpose.
The User expressly accepts that Neki will not be obliged to make the information prior to contracting available to the User or to confirm receipt of the acceptance established in articles 27.1 and 28.1 of Law 34/2002, of July 11, of services of the information society and electronic commerce ("LSSI") by virtue of the provisions of articles 27.2 and 28.3 of the LSSI.
Neki will confirm the contract and its terms by sending an email to the address provided by the User.
The User will be able to download the invoice from their user profile in Neki.
Price and method of payment
The prices indicated in the contracting form will be applicable to the devices. Unless otherwise indicated, the prices shown to the User before contracting will include the VAT applicable at all times and depending on the residence and circumstances of the client. Neki may request the information it deems appropriate to prove any point that is relevant for the purposes of applying VAT to the invoices issued. It is the sole responsibility of the User to know and settle the corresponding fees and taxes in their country of residence or origin.
The User can pay for the Products and Services that he wishes to purchase with a Visa or Mastercard credit card or by PayPal.
4. User responsibility
The User is fully and solely liable for the Advertisement and for any contracts entered into with Neki’s users related to such Advertisement. The User undertakes to indemnify and hold Neki harmless of any expense, costs, liability and loss of any kind (including lawyers fees, even if their participation is not strictly required) incurred by Neki as a result of any claim of a Neki user which acquires the services or products offered by the User in the Advertisement. Likewise, the User will indemnify and keep Neki harmless of any liability resulting from any breach of the warranties over the Advertisement provided by the User or any other obligation of the User under these Terms.
5. Neki's responsibility for the sale of devices.
Notwithstanding the limitations of liability established in the Conditions of Use, Neki does not guarantee that the devices can be interrupted, safe, temporary, free of errors, exact, reliable, of a certain quality or reliability, that any error will be corrected.
The maximum responsibility of Neki under the contract with the User will be the return to the User of the remuneration received from that User in relation to the Services. EXCEPT IN CASES OF WILFUL MISCONDUCT, NEKI SHALL NOT BE LIABLE FOR ANY DAMAGE OF ANY NATURE THAT IS GENERATED TO THE USER IN RELATION TO THE SERVICES, EXCEPT IN THE TERMS EXPRESSLY ESTABLISHED IN THIS CLAUSE.
6. Resolution
Neki may stop providing the Services unilaterally if it considers that, in any way, the user breaches these Conditions, the mere communication being sufficient for this. The User accepts that Neki will not incur in any responsibility due to the resolution of the provision of the Services in these terms.
